Environmental Impact Assessment

Presidential Decree No. 1586, s. 1978, established the Environmental Impact Statement System and provides that no person, partnership or corporation shall undertake or operate any project declared as environmentally critical or is located within an environmentally critical area without first securing an Environmental Compliance Certificate (ECC) issued by the President or his duly authorized representative.
Administrative Order No. 42 of 2002 streamlined the EIS processing system and delegated the ECC approving authority to the Secretary of the Department of Environment and Natural Resources (DENR) and the Director and Regional directors of the Environmental Management Bureau (EMB) of the DENR.

The DENR Secretary issued Administrative Order No. 61, Series of 2004, delegating to the LLDA General Manager the authority to grant or deny the issuance of Environmental Compliance Certificate / Certificate of Non-Coverage (ECC/CNC) for projects located within the Laguna de Bay Region.

The LLDA adopted the Environmental Impact Assessment (EIA) System and its Implementing Rules and Regulations in the Laguna de Bay Region starting 01 December 2004 (LLDA Board Resolution No.234, Series of 2004).

Environmental Compliance Certificate (ECC) PDF  | Print |  E-mail

An ECC is a document issued by the DENR/EMB after a positive review of an ECC application, certifying that the proponent has complied with all the requirements of the EIS System and has committed to implement its approved Environmental Management Plan.

Certificate of Non-Coverage PDF  | Print |  E-mail

A Certificate of Non-Coverage or CNC is a certification issued by EMB/ LLDA certifying that , based on submitted project description, the project is not covered by the EIS system and is not required to secure an ECC.

Any project not covered by the EIS system can apply for a CNC.  Securing a CNC is not mandatory, it is voluntary as needed by project proponents (e.g. bank financing, ISO recognition or awards, etc.).

The Philippine Environmental Impact Statement (EIS) System is used to enhance planning and guide decision making.  (It is also referred to as the Philippine Environmental Impact Assessment (EIA) System.)

Through the EIA process, adverse environmental impacts of proposed actions are intended to be considerably reduced through the subsequent formulation of appropriate Environmental Management and Monitoring Plans.
A positive review of the EIA Report results to the issuance of an Environmental Compliance Commitment (ECC) document to be conformed to by the proponent and represents the project/program’s Environmental Compliance Certificate .

The issuance of the ECC which is required for Environmentally Critical Projects (ECPs) and projects within Environmentally Critical Areas (ECAs) allows the project to proceed to the next stage of project planning which is the acquisition of approvals from other government agencies and LGUs, after which the project can start implementation.

DENR Department Administrative Order 2003-30 along with its Revised Procedural Manual of August 2007 contains more detailed guidelines and procedures in the implementation of the Philippine EIS System.
